Article 2 – Scope and Acceptance

These Terms of Service apply to all access to, use of, purchases from, and transactions made through whisperingwoodsstudio.com.

By visiting our website, placing an order, creating an account, or otherwise using our services, you agree to be bound by these Terms of Service.

Article 3 – Services and Products

Whispering Woods B.V. offers handcrafted jewelry display products and related accessories through its online store.

We provide both ready-to-ship products and, where stated on the product page, custom-made or personalized products.

Unless expressly stated otherwise on the product page, products sold through our store are one-time purchases only and do not involve recurring billing, subscriptions, or automatic renewals.

We make every effort to present product descriptions, dimensions, materials, colors, textures, and images as accurately as possible. However, because natural materials and screen settings may vary, minor differences may occur and do not necessarily constitute defects.

Obvious typographical errors, pricing errors, or other clear mistakes are not binding and may be corrected.

Article 4 – Account Registration and Use

Customers may place orders as guests unless account registration is required for a particular feature or service.

If you create an account, you are responsible for keeping your login credentials confidential and for all activity carried out through your account.

You agree to provide accurate, complete, and up-to-date information when placing an order or creating an account.

Article 5 – Prohibited Conduct

You may not use the website or services for any unlawful, fraudulent, abusive, or unauthorized purpose.

You may not misuse the website, interfere with its operation, attempt unauthorized access, upload malicious code, infringe intellectual property rights, or use false or misleading information when placing an order.

Whispering Woods B.V. reserves the right to refuse service, cancel orders, suspend accounts, or restrict access where misuse, fraud, or unlawful activity is suspected.

Article 6 – Orders and Formation of Contract

An order becomes binding only after the customer completes the checkout process and receives an order confirmation email.

Whispering Woods B.V. reserves the right to refuse, limit, or cancel any order in cases including suspected fraud, incorrect pricing, stock issues, incomplete customer information, or unauthorized use of our services.

Article 7 – Prices and Payments

All prices are displayed in the currency shown on the website or at checkout.

Payments are securely processed through Shopify Payments and other supported payment methods, including major credit cards, Apple Pay, and Google Pay, where available.

Shipping charges, customs duties, import taxes, VAT, and other applicable charges are handled as shown at checkout.

Where applicable, customs duties, import taxes, and VAT are included in the final amount shown at checkout.

For orders delivered to the United Kingdom, VAT is charged at 20 percent.

For orders delivered to countries within the European Union, VAT is charged at the rate applicable in the destination country.

For other destinations, customers should not be charged additional duties or taxes unless such charges are clearly stated at checkout.

Customers should review all checkout information carefully before completing their purchase.

Article 8 – Shipping, Delivery, and Fulfillment

All non-custom orders are dispatched on the next business day.

Custom-made or personalized items may require additional production time before dispatch. Where applicable, this will be stated on the relevant product page.

We offer standard and expedited shipping options. Standard shipping generally takes 5 to 9 business days after dispatch. Expedited shipping generally takes 3 to 5 business days after dispatch.

Free standard shipping is available for orders delivered to the United States, Canada, the United Kingdom, and Australia when the order value meets the applicable minimum threshold shown on our website and at checkout.

Current free standard shipping thresholds are:
United States: orders over USD 25
United Kingdom: orders over GBP 19
Canada: orders over CAD 35
Australia: orders over AUD 35

For other destinations, available shipping options, delivery estimates, and any applicable shipping fees are shown at checkout before payment.

Expedited shipping is available at checkout for an additional fee. We commonly use FedEx for expedited shipping, depending on destination and service availability.

Orders are managed by Whispering Woods B.V. in the Netherlands and may be fulfilled from our production studio in Hangzhou, China.

Delivery times are estimates only and are not guaranteed. Delays may occur due to customs clearance, weather conditions, carrier disruptions, peak periods, or other circumstances beyond our reasonable control.

Article 9 – Shipping Address and Risk Transfer

Customers are responsible for ensuring that the shipping address entered at checkout is accurate and complete.

If an order is returned because of an incorrect or incomplete shipping address provided by the customer, additional reshipping charges may apply.

Risk of loss or damage passes to the customer upon delivery of the goods to the shipping address provided at checkout, except where applicable law provides otherwise.

Article 10 – Returns and Right of Withdrawal

Eligible returns may be requested within 30 calendar days after the order is marked as delivered.

To request a return, the customer must email info@whisperingwoods.store within the return period and provide either the order number or the recipient name used for the order.

Returned items must be unused, in original condition, and returned in original packaging where possible.

Return shipping costs are borne by the customer unless the item arrives damaged, defective, or incorrect.

Refunds are issued to the original payment method within 14 days after the returned item has been received and inspected.

If the customer selected expedited shipping, the expedited shipping fee is non-refundable.

If a standard shipping charge was paid, that standard shipping fee may be refunded where applicable.

Consumers in the EU or EEA may also have a statutory right of withdrawal within 14 days of receiving the goods, except where a legal exclusion applies.

Article 11 – Exclusions from Return or Withdrawal

To the extent permitted by law, the right of withdrawal, cancellation, or return does not apply to custom-made, personalized, or bespoke items.

Business-to-business orders are not covered by consumer withdrawal rights unless otherwise agreed in writing.

If a custom-made or personalized item arrives damaged, defective, or incorrect, the customer should contact info@whisperingwoods.store immediately.

Article 12 – Damaged, Defective, or Incorrect Items

If a parcel arrives damaged, the customer must contact info@whisperingwoods.store within 72 hours of delivery and provide the order number together with clear photos of the damaged item and packaging.

Once the claim is received, Whispering Woods B.V. will contact the shipping carrier within 72 hours and inform the customer of the next steps to resolve the issue.

Depending on the circumstances, the resolution may include a replacement or a refund.

If a customer receives an incorrect or defective item, the customer should contact info@whisperingwoods.store as soon as possible and provide the order number together with clear photos of the issue.

If the claim is approved, Whispering Woods B.V. will provide an appropriate remedy, which may include a replacement, partial refund, or full refund.

Article 13 – Warranty and Complaints

Whispering Woods B.V. aims to supply products that meet reasonable quality standards and conform to the product description.

Any complaint or claim should be submitted to info@whisperingwoods.store within a reasonable time after discovery.

We will review the complaint and respond within a reasonable time.

Article 14 – Intellectual Property

All content on this website, including but not limited to text, product descriptions, product names, photography, graphics, logos, trademarks, branding, designs, layout, concepts, and visual materials, is the intellectual property of Whispering Woods B.V. or its licensors, unless otherwise stated.

No content may be copied, reproduced, distributed, modified, published, displayed, or otherwise used without prior written permission.

Article 15 – Website Availability and Disclaimer

We make reasonable efforts to ensure that the website and its content are accurate, current, and accessible. However, we do not guarantee that the website will always be uninterrupted, error-free, secure, or free from technical issues.

To the extent permitted by law, Whispering Woods B.V. is not liable for interruptions, technical problems, temporary unavailability, or inaccuracies in website content that do not affect mandatory consumer rights.

Article 16 – Limitation of Liability

To the maximum extent permitted by law, the liability of Whispering Woods B.V. is limited to the total invoice value of the relevant order.

Whispering Woods B.V. shall not be liable for indirect, incidental, consequential, or special damages, except where such limitation is not permitted by law.

Nothing in these Terms excludes or limits liability that cannot legally be excluded.

These Terms of Service and any agreements between the customer and Whispering Woods B.V. are governed by the laws of the Netherlands.

If you are a consumer, this choice of law does not deprive you of any mandatory consumer protection rights that apply under the laws of your country of residence.

Any dispute arising out of or relating to these Terms or any purchase made through the website shall be submitted to the competent court of The Hague, the Netherlands, unless mandatory law provides otherwise.
